The terms on which Deal The Night provides casino-themed offline event entertainment in Australia.

1. Parties
These terms apply between Deal The Night, trading as Deal The Night, of 89 Flinders St, Melbourne VIC 3000, Australia (“we”, “us”) and the person or organisation that books an event or hires equipment from us (“you”, “the client”). They apply to use of this website and to any event we deliver, together with the written quote and booking confirmation for your event. Where a signed booking agreement conflicts with these terms, the booking agreement prevails for that event.
2. The service
We provide the organisation of casino-themed offline events in Australia: casino-themed offline event entertainment. Depending on your booking, that may include supply and installation of casino-themed event tables, professional croupiers and hosts, symbolic chips and cards, table dressing and signage, branded items, floor planning, run sheet preparation, event management on the night, team-building facilitation and pack-down.
Events are delivered in person at a venue nominated by you, normally for up to 6 hours of table time and for up to 350 guests, with the exact scope set out in your written quote.
3. Not a gambling service
This is strictly offline event entertainment. There is no real-money gambling, no betting, no cash prizes, and no online casino service.
Specifically, and as a condition of the service:
- guests play with symbolic chips or points that have no monetary value;
- there is no buy-in, no stake, no wager and no cash-out of any kind;
- we do not pay out money, vouchers or prizes of monetary value as a result of play;
- we do not accept money from guests at any table;
- we do not operate, host, resell or promote any online casino, betting or real-money gambling platform;
- standings exist only for the duration of the event and have no value afterwards.
You must not use our equipment, staff or event to facilitate gambling, wagering or any exchange of money or money's worth connected with play. If that occurs, or we reasonably believe it is about to, we may suspend or end the event immediately without refund, and we are not liable for any resulting loss.
4. Adults-only events
All our events are restricted to participants aged 18+. You are responsible for ensuring that only adults take part. Our staff may decline to involve any person who appears to be under 18 and cannot produce acceptable identification, and may close a table if that restriction cannot be maintained.
5. Enquiries and quotes
Submitting the enquiry form does not create a booking and does not hold a date. We respond with availability and, where appropriate, a written quote describing the concept, table mix, staffing, timings and price. A quote is valid for 30 days unless it says otherwise, and is based on the information you have given us. Pricing depends on event size, venue and chosen format; we do not publish prices because each quote is prepared for a specific event concept.
6. Bookings
A booking exists only when you accept a written quote and we confirm the booking in writing, and any agreed booking deposit has been received. Dates are allocated in order of confirmation; we cannot hold a date against a verbal indication. We may decline a booking - for example where the venue is unsuitable, the access is unsafe or the brief conflicts with section 3 or 4.
7. Payment terms
Payment terms are set out in your written quote and booking confirmation and typically comprise a booking deposit on confirmation and the balance due before or shortly after the event, by electronic funds transfer. No amounts are published on this website. Where applicable, GST is shown separately on your invoice. Overdue invoices may attract reasonable recovery costs and interest as stated in your booking agreement.
8. Changes to a booking
Tell us as early as possible if guest numbers, timings or the venue change. We will accommodate reasonable changes where staffing and equipment allow, and will confirm in writing any effect on the quoted price. Significant changes close to the event date may not be possible, because staff and equipment are committed in advance.
9. Cancellation and postponement
Cancellation and postponement terms are set out in your booking agreement. The principle we apply is that the closer a cancellation falls to the event date, the greater the proportion of committed costs - staff, freight, branded items already in production - that cannot be recovered. Requests must be made in writing. Where we are unable to deliver a confirmed event for reasons within our control, you may cancel and receive a refund of amounts paid for the undelivered service.
10. Client responsibilities
- provide accurate guest numbers, timings and venue details;
- obtain any venue permissions, licences or approvals needed for your event;
- ensure the venue provides safe access, adequate space, suitable flooring and power near each table;
- ensure that only adults aged 18+ participate;
- nominate a contact who is present and reachable during the event;
- ensure guests treat our staff and equipment with reasonable care.
11. Venue, access and set-up
We will confirm bump-in and pack-down windows, access routes and equipment dimensions before the event. If, on arrival, access differs materially from what was described - a lift that is too small, a route that is unsafe, a surface that cannot take the tables - we may be unable to install some or all of the equipment. We will do our best to find an alternative, but we are not liable for a shortfall caused by inaccurate venue information.
12. Conduct on the night
Our staff may pause or close a table where behaviour is unsafe, where a guest is significantly affected by alcohol, where equipment is being damaged, or where anyone attempts to introduce money into play. We will always try to resolve the situation discreetly and with your nominated contact first.
13. Equipment and damage
All equipment, chips, cards and dressing remain our property. You are responsible for loss or damage to our equipment at your event caused by you, your guests or your other suppliers, beyond fair wear and tear. We will tell you promptly, with photographs and a reasonable cost of repair or replacement.
14. Limitations of the service
We do not provide gambling services, betting services, cash prizes, financial services or any online platform. We are not a venue, a caterer, a licensee or a liquor supplier, and we do not supply or imitate gaming machines. Nothing in our service, website or materials is an inducement to gamble.
15. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are permitted to limit our liability, our total liability in connection with an event is limited, at our option, to re-supplying the service or paying the cost of having it re-supplied, and in any case to the amount you have paid us for that event.
To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, loss of opportunity or reputational loss, or for loss caused by a venue, caterer or other third party you have engaged.
16. Force majeure
Neither party is liable for failure to perform caused by an event beyond its reasonable control, including natural disaster, extreme weather, fire, flood, public health direction, government restriction, venue closure, industrial action or failure of essential utilities. Where such an event prevents delivery, we will work with you to reschedule, and amounts already paid will be credited to the rescheduled date wherever possible.
17. Intellectual property
The content, design, text and images of this website belong to us or our licensors and may not be copied or reused without permission. Where you supply artwork for branded chips, cards or signage, you confirm that you have the right to use it and you permit us to reproduce it for your event.
18. Privacy
We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Cookies and consent are explained in our Cookie Policy.
19. Governing law
These terms are governed by the laws of Australia and, where applicable, the laws of the State of Victoria. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
